Gujarat permits registration, modification of sidecar-fitted motorcycles for Divyang persons

Gandhinagar, Aug 21 (AHN) Gujarat has allowed the registration and modification of motorcycles fitted with sidecars for Divyang persons, including Mano Divyang, with the state Transport Commissioner directing RTO and ARTO offices to follow the Central Government’s prescribed guidelines.
The move is aimed at providing a safer and more independent mobility option for persons with disabilities who may face difficulties using conventional two-wheelers or other forms of transport.
The Commissioner of Transport has issued a circular under which motorcycles can be registered or modified with sidecars, subject to prescribed technical, legal and safety requirements.
The provision also specifically covers Mano Divyang persons, for whom the circular sets out requirements relating to ownership, guardianship and operation of the vehicle.
In such cases, the motorcycle must be driven by a legal guardian or an authorised person with the guardian’s knowledge and consent. The person operating the vehicle must hold a valid driving licence for the relevant category.
The circular places several conditions on the use of such motorcycles. The vehicle must not be driven at more than 40 kmph under any circumstances.
Helmets will be mandatory for both the driver and the passenger, including the Mano Divyang person travelling in the sidecar. The sidecar must also be fitted with a suitable seat belt or another appropriate safety restraint system.
Before registration or approval of any modification, the vehicle will be physically inspected to ensure that the sidecar and other alterations do not create a safety risk for the driver, the Divyang passenger or other road users.
The vehicle must also have a valid comprehensive insurance policy with at least third-party risk cover.
All applicable provisions of the Motor Vehicles Act, 1988, and other relevant rules, guidelines and instructions will have to be complied with.
The state government said the provision was intended to address mobility difficulties faced by Divyang persons in their daily lives and facilitate greater independence.
All RTO and ARTO offices across Gujarat will implement the provision in accordance with the Central Government’s standards and guidelines.
The decision provides a formal framework for the registration and modification of sidecar-fitted motorcycles while placing specific safeguards around who can drive them, how they can be used and the safety equipment required.
