Patna HC: Religious Rights Subject to Reasonable Restrictions to Maintain Public Order

The Patna High Court has ruled that the right to profess and practise religion is not absolute and can be reasonably restricted to maintain public order, peace and societal interests. The court made the observation while dismissing a plea seeking permission for 300 devotees to join an annual religious procession in Bihar's Siwan district. Authorities had limited participation and altered the traditional route, citing security concerns. The court said Articles 25 and 26 protect religious freedom but remain subject to public order, morality and health. It added that religious practices must be balanced with the rights of others and prevailing law-and-order conditions.
