Delhi High Court Hears Petition Challenging Legality of CCI's Settlement Framework

A writ petition has been filed in the Delhi High Court challenging the constitutional validity of the Competition Commission of India's (CCI) settlement framework under the Competition Act. The plea argues that the current provisions deny consumers, informants, competitors, and other affected parties an opportunity to object to settlement orders issued by the regulator. The petition also questions Section 48A(7) of the Competition Act and the CCI (Settlement) Regulations, 2024, claiming they violate Articles 14 and 21 of the Constitution by lacking transparency and a fair procedure. It further contends that competition cases have wider public implications and that affected stakeholders should be allowed to participate before settlements are finalized.
